Temporary Restraining Orders and Permanent Restraining Orders

All violence cases are analyzed individually to determine the appropriate sentence. Based on the evaluation by prosecutors and the legal defense, a judge may issue a protection order, or a temporary or permanent restraining order.

Temporary Restraining Order

This refers to an order that is valid for a specific period of time.

According to the law, the abuser is not allowed to approach the protected person.
Depending on the severity of the case, a judge may also prohibit the abuser from any form of contact, such as emails, phone calls, video calls, among others.

Permanent Restraining Order

This prohibits a person from approaching or communicating with their partner or ex-partner on a permanent basis. In other words, as long as the restraining order is in effect, they may not establish:

  • In-person

  • Verbal

  • Written

communication with the protected person.
